Parking Policy

MidCity Lofts Parking and Parking Garage Policy
Effective August 11, 2008

1.0 Objective

1.1 The first objective of this policy is to ensure that access to and utilization of the amenity of visitor parking is maintained fairly for the benefit of Unit Owners and Occupants. The second objective of this policy is to maintain and preserve the value of the common and limited common elements of the parking garage.

1.2 The Board of Directors may adopt reasonable rules and regulations in accordance with these terms and as specified in the governing legal documents as needed in order to carry out the objective of this policy. This policy shall be implemented in accordance with Exhibit F of the Declaration of Condominium for MidCity Lofts, A Condominium (“Declaration”).

2.0 Usage/Schedule

2.1 Visitors of building occupants, excluding customers of Live-Work Units as outlined in Section 3.0, may park in designated guest parking spaces according to the schedule as defined in Subsection 2.4.

2.2 Visitors may park in designated guest parking spaces while visiting building occupants, subject to Subsections 2.3 and 2.4. Neither Unit Owners nor Occupants are permitted to park in designated guest parking spaces at any time.

2.3 Only one guest parking space may be occupied by visitor(s) of any one Unit, including Live-Work Units, at any one time.

2.4 The schedule for usage of guest parking is as follows:

Monday through Friday from 8 a.m. to 5 p.m. - A visitor who parks in a designated guest parking space during weekdays is restricted to a six (6) hour maximum time limit.

Sunday through Thursday from 5 p.m. to 8 a.m. - A visitor who has parked in a guest parking space after 5 p.m. on weeknights must move his/her vehicle prior to 8 a.m. the following weekday. A visitor is allotted one overnight parking privilege once per calendar week, Sunday through Thursday. This privilege may be extended by the Unit Owner or Occupant hosting the visitor. Extensions are subject to the procedures outlined in Subsection 5.2.

Friday at 5 p.m. through Sunday at 5 p.m. and Holidays - A visitor may park in a designated guest parking space for a period not to exceed twenty four (24) hours on weekends and government observed holidays.

3.0 Live-Work Units

3.1 This section is subject to Exhibit F of the Declaration of Condominium.

3.2 Guest parking shall be reserved for visitors, customers and clients of Owners or Occupants of the Live-Work Unit only. Employees of a Live-Work Unit business are prohibited from parking in designated guest spaces at any time.

3.3 Only one designated guest space may be occupied per Live-Work Unit at any one time.

3.4 Customers, patrons or clients of any business operating out of a Live-Work Unit are subject to the following schedule:

Monday through Friday from 8 a.m. to 5 p.m. - There is a two (2) hour maximum time limit for usage of a guest parking space during weekdays for visitors, customers or clients of the businesses occupying a Live-Work Unit.

Sunday through Thursday from 5 p.m. to 8 a.m. - There is a two (2) hour maximum time limit for usage of a guest parking space during weeknights for visitors, customers or clients of the businesses occupying a Live-Work Unit. An exception will exist if the Unit Owner or Occupant lives full-time in the Live-Work Unit and Subsections 2.4 and 5.2 will apply.

Friday at 5 p.m. through Sunday at 5p.m. and holidays - There is a two (2) hour maximum time limit for usage of a guest parking space during weekends and government observed holidays for visitors, customers, or clients of the businesses occupying a Live-Work Unit. An exception will exist if the Unit Owner or Occupant lives full-time in the Live-Work Unit and Subsections 2.4 and 5.2 will apply.

4.0 Storage

4.1 A Unit Owner or Occupant may store up to one (1) foldable two-wheeled cart and non-motorized bicycle in each parking space assigned to his/her Unit.

4.2 Storage containers must be approved the Board. Only approved storage containers may be stored in the parking garage or in parking spaces. A Unit Owner or Occupant may store one storage container in each parking space assigned to his/her Unit. Reference Exhibit A of this policy for examples of acceptable storage containers.

4.3 Items not included in Subsections 4.1 and 4.2, and excluding motorized vehicles, motorcycles or hard tops, are prohibited from being stored in parking spaces or the parking garage. Unit owners or Occupants who store prohibited items in the parking garage and/or parking spaces will be issued a written Notice for Removal. After ten (10) days, the items will be removed and the Unit Owner or Occupant will be charged for cost of the removal or disposal.

4.4 Hazardous or flammable materials are not permitted in the parking garage at any time.

 

5.0 Procedures

5.1 Visitors may access the garage through the Abercrombie Street entrance only. Visitors must sign in with the concierge and will be issued a parking permit which must be displayed on the driver’s side dashboard of their vehicle at all times.

5.2 Unit Owners and Occupants may request an extended guest parking permit by applying in writing to the Management agent at a minimum of forty eight (48) hours prior to the intended extension. The Management agent will issue the extended permit to the Unit Owner or Occupant.

5.3 Contractors are not permitted to park in guest parking but may park in the parking space assigned to the Unit which the contractor is visiting. For purposes of this policy, a contractor is defined as a person who is visiting a Unit Owner or Occupant for the purpose of providing goods or services.

5.3.1 Examples of contractors include, but are not limited to, cleaning persons, carpenters, dry wall installers, electricians, handymen or delivery persons. The purpose of the visit, not the type or signage on the vehicle, defines a contractor for purposes of this policy.

5.3.2 Persons who provide a consulting service to Unit Owners or Occupants and who do not perform physical work in a Unit may park in guest parking. Examples include real estate agents, insurance agents or interior designers.

5.4 Prior to entering the building or utilizing the loading dock, contractors must sign in with the concierge and abide by the policies and procedures set forth in the Contractor Policy.

 

6.0 Restrictions

6.1 Only one (1) motorized passenger vehicle or two (2) motorcycles may be parked per lined parking space.

6.2 Disabled vehicles are prohibited from being parked in the parking garage, except in a Unit assigned parking space. A vehicle that does not have a current license tag or is inoperable shall be considered disabled. A disabled vehicle is subject to towing at the expense of the Unit Owner or Occupant without notice unless prior, written approval is obtained from the Management agent. The Management agent, at his/her discretion, may approve or deny the request.

6.3 Motor vehicles shall be operated and parked only upon those portions of the common elements designated specifically for such purpose by the Board of Directors of the Association. The Board of Directors of the Association may prohibit mobile homes, motor homes, truck campers, trailers of any kind, motorcycles, motorized bicycles, motorized go-carts or other such contrivances from being kept, placed, stored maintained or operated upon any portion of the Property if in the opinion of the Board of Directors there is insufficient space to accommodate same or such prohibition is in the best interests of the Condominium. (Reference Declaration, Exhibit “F”, Subsection 10, “Motor Vehicles, Trailers, Parking, Etc.”).

6.4 Vehicles leaking oil or fluids that may discolor the parking garage floor are not permitted in either common elements or assigned parking spaces. A Unit Owner or Occupant who parks a vehicle that is leaking oil or fluids is required to notify the management agent within twenty four (24) hours of discovering the leak. Furthermore, Unit Owners or Occupants who park vehicles which are leaking fluids are required to purchase and maintain a mat or other Board approved protective material under the car for the purpose of protecting the garage floor from discoloration or damage. The Unit Owner or Occupant will have forty eight (48) hours to install protective material under the leak. Failure to install protective material after forty eight (48) hours will result in cost of cleaning and/or repair to be charged to the Unit Owner or Occupant. Reference Exhibit B of the policy for examples of acceptable protective materials.

6.5 Vehicles parked in a Unit Owner’s or Occupant’s parking space without approval from that Unit Owner or Occupant are subject to towing according to the following conditions.

6.5.1 The Unit Owner or Occupant must provide notification to the management agent or concierge personnel of the infraction. The management agent or concierge personnel will contact the vehicle owner only as a courtesy if contact information has been provided by such owner. If the vehicle is not moved in order to conform to this policy immediately, the vehicle will be towed at the vehicle owner’s expense.

6.5.2 Vehicles that extend six (6) inches or greater into the common drive or that are parked over the line of an adjacent space assigned to another Unit Owner or Occupant are subject to towing. The Unit Owner or Occupant must provide notification to the management agent or concierge personnel of the infraction. The management agent or concierge personnel will contact the vehicle owner only as a courtesy, if contact information has been provided by such owner. If the vehicle is not moved in order to conform to this policy immediately, the vehicle will be towed at the vehicle owner’s expense.

6.6 Towing will be implemented with the approval of the Management agent.

6.7 Unit Owners or Occupants who are in arrears by more than sixty (60) days with regard to Association fees or non-payment of previous related or unrelated fines will not be granted access to guest parking for visitors.

6.8 Unit Owners or Occupants shall not permit visitors to follow their vehicles into the parking garage (“tailgating”). Visitors are required to utilize the callbox on Abercrombie Street to obtain access to the parking garage.

 

7.0 Other Procedures

7.1 If any vehicle is parked on any portion of the common elements or assigned parking space in violation of the rules and regulations, including, but not limited to, this parking policy, a notice will be placed on the vehicle specifying the nature of the violation and stating that after twenty-four (24) hours the vehicle will be towed. Exceptions are noted in Subsections 6.5 and 7.3.

7.2 If twenty-four (24) hours after such notice is placed on the vehicle the violation continues or recurs within six (6) months of the initial notice, the vehicle may be towed without further notice to the owner of the vehicle.

7.3 Certain areas of the common elements post signs restricting parking to Active Loading and Unloading only. All Unit Owners, Occupants, visitors, contractors and other persons must abide by these posted restrictions. Failure to do so will result in the vehicle being towed immediately at the vehicle owner’s expense.

 

8.0 Policy Exceptions

8.1 All one time exceptions to this policy must be approved by a majority vote of the Board. All permanent changes to this policy must be approved by a majority vote of the Board or as defined by the By-Laws and Declaration.
