Contractor/Homeowner Construction Policy
Effective January 31, 2006
Construction in a midrise concrete and steel condominium has its own peculiarities. The following rules are designed to maintain the structural integrity of the building and to balance homeowners’ quiet enjoyment of the building with the construction needs of owners.
Construction by Owners
Owners must receive written permission from the board prior to making structural changes to a unit. Any construction, alteration, modifications or change must be within the restrictions of the condominium documents.
Any alteration, modification or change to the common areas or the exterior of the building is prohibited.
The owner is responsible for obtaining any construction permits from the appropriate governmental authorities needed to perform construction. The Association, through the management company, must receive a copy of the permits prior to the start of construction.
No owner may undertake construction that will place the building, other units, unit owners or the Association at risk. The Board, in its discretion, may require the owner to provide written certification from a structural or other engineer indicting that the proposed modifications will not affect the structural integrity of the building and/or overload of the existing building systems.
Examples of Renovations That Require Board Approval
The following list, while not all-inclusive, is meant to illustrate the type of renovation that must receive
Board approval prior to commencement of construction:
- Any modification to structural and/or load-bearing walls;
- Any alteration within a unit which involves connecting to common element pipes, lines, conduits and/or other apparatus for access to common utilities;
- Any major demolition of walls, doors, windows, or any intrusion into concrete. Warning: No more than 3/4 inch intrusion into concrete is permitted;
- Replacement of drywall;
- Any changes to the unit’s flooring, such as hardwood floors, tile, brick, etc.;
- Replacement of sinks, bathtubs or toilets;
- Electrical work requiring rerouting of conduit, moving junction or breaker boxes, or electrical outlets;
- Plumbing requiring the rerouting of pipes or the installation of new seals or cutoffs;
- Any work requiring City of Atlanta building permits.
Contractors
Homeowners must provide the Concierge with the name of any contractor performing work at MidCity Lofts prior to the commencement of such work. Contractors must be notified by the owner that in order to commence work at MidCity Lofts, the contractor must abide by the following policies:
- Contractor must have valid Workers’ Compensation Insurance;
- Contractor must be licensed as required by the State to perform such work;
- Contractor’s work must meet all the code requirements of the City of Atlanta and Fulton County;
- Contractor must not disable any system used for the express safety of the building (i.e. sprinkler system, fire detection devices, etc.);
- Contractor may not perform work outside of the unit in the common areas (i.e. cutting of wood, paint, cleaning, etc.);
- Trash chutes and dumpsters must not be used for disposal of construction materials;
- Contractors and/or unit owners are responsible for any damage to the freight elevator and all common areas;
- Contractors and/or unit owners are responsible for the safe disposal of all construction materials;
- Common areas may not be used for the storage of construction materials, tools or as prep areas;
- Contractor or owner must clean all debris in common areas;
Management may inspect premises at any time with prior notice to the owner.
Contractor Check in/Out
- Contractor’s working hours: Monday through Friday: 8:30 a.m. - 5:00 p.m.
- Prior to entering the building, contractors must check in with the Concierge Desk.
- For security reasons, contractors are not permitted in the parking garage. Contractors should unload their vehicles at the loading dock. All homeowners have been provided with a diagram of the building that details where a contractor may unload; homeowners should fax this diagram to their contractors prior to the beginning construction to avoid confusion.
- All contractors must sign in and be admitted by owner, either by phone call or by written prearrangements with concierge;
- The freight elevator, not the elevators located in the lobby, must be used to carry all materials to units;
- Contractors may prop security door to elevator lobby to load materials into freight elevator lobby, but must close the security doors before loading the materials into the elevator.
- The Concierge will issue a key fob to any contractor who will be using the freight elevator. The Contractor must provide a driver’s license or a $50 deposit that will be refunded upon return of the key fob;
- Contractors must wear adhesive name tags issued by the concierge at all times while on the MidCity Lofts’ premises. The nametag must identify the contractor’s name, last name of the homeowner, and the unit number;
- Contractors must sign out with concierge when leaving.
- Homeowners must ensure that the Contractor receives a copy of the MidCity Lofts’ Contractor Policy prior to commencing work at MidCity Lofts.
Lessees
No lessee may make any modifications to the unit that he or she is occupying without the express written permission of the unit owner and, when necessary, the Association. Lessees are subject to the restrictions of the condominium documents and owners may not permit lessees to violate these restrictions. Owners are responsible for ensuring that lessees adhere to the Association’s rules and regulations.
Acknowledgment of Policy
Homeowner acknowledgment of the rules and regulations set forth in this policy must be confirmed by signing below prior to commencing construction. Failure to do so may result in a fine.
